Markey emphasizes the importance of defining “private paramilitary organization” as any group of three or more persons associating under a command structure for combat, combat support, law enforcement, or security services.

Exceptions and Clarifications

WHile aiming to regulate these activities, the bill makes exceptions for members of the National Guard, military reserve components, state guard forces, and other federally or state-organized groups engaged in paramilitary, law enforcement, and security service activities. Additionally, allowances are made for groups focused on military reenactments, veterans organizations with no intent for prohibited activities, and students in government-authorized educational institutions teaching military science.

Capitol Breach Sparks Legislative Action

Sen. Markey and Rep. Raskin introduced the legislation in response to the Capitol breach on Jan. 6, 2021. The lawmakers assert that that private paramilitary groups, such as the Oath Keepers, the Three Percenters, and the Proud Boys, have been utilizing political violence to intimidate and threaten democratic governance and the rule of law. The bill aims to clarify that such paramilitary operations are not protected by the Constitution.

Addressing Past Incidents

The proposed legislation takes into account incidents involving armed organizations, such as the Proud Boys, engaging in confrontations with counter-demonstrators, as well as left-wing groups supporting the Black Lives Matter movement durring the summer of 2020. The lawmakers emphasize the need to prevent unauthorized activities that interfere with the constituional rights of individuals.
